These Terms of Service ("Terms") govern your access to and use of the Hadeda mobile application ("App"), and any services, features, or content (collectively, "Services") provided by Hadeda. By accessing or using the Services, you agree to be bound by these Terms.
In order to use the Services, you must register for an account with Hadeda. You must provide accurate and complete information when creating your account, and you are responsible for maintaining the confidentiality of your account login information. You are also responsible for all activities that occur under your account. Hadeda reserves the right to suspend or terminate your account at any time, with or without notice, for any reason or no reason.
The Services allow you to post content, such as text, photos, and other materials. You retain all rights in, and are solely responsible for, the content you post on the App. By posting content on the App, you grant Hadeda a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, display, reproduce, modify, and distribute your content on the App and through the Services.
The Hadeda web application and Services are available at https://hadeda.org.
The Services allow users to follow other users and like posts. You may follow any user on the App and like any post. The Services also allow you to filter your feed to show all posts, top daily posts, posts from people you are following.
The App and Services are protected by copyright, trademark, and other laws of South Africa and foreign countries. Except as expressly provided in these Terms, Hadeda and its licensors exclusively own all right, title, and interest in and to the App and Services, including all associated intellectual property rights. You may not remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the App or Services.
The App and Services are provided "as is" without warranty of any kind, either express or implied, including without limitation any warranty for information, services, uninterrupted access, or products provided through or in connection with the App or Services, including without limitation the software licensed to you and the results obtained through the App or Services. Specifically, we disclaim any and all warranties, including without limitation: 1) any warranties concerning the availability, accuracy, usefulness, or content of information, products or services; and 2) any warranties of title, warranty of non-infringement, warranties of merchantability or fitness for a particular purpose. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.
These Terms and any action related thereto will be governed by the laws of South Africa without regard to its conflict of laws provisions.
Hadeda reserves the right to modify these Terms at any time in its sole discretion. If we make a material change to these Terms, we will provide you with reasonable notice prior to the change taking effect. Your continued use of the App or Services after the revised Terms have become effective indicates that you have read, understood, and agreed to the current version of these Terms.
